DOJ To Beef Up Corporate Fraud Enforcement? Oh Happy Day!

Word is that the DOJ is seriously beefing up the fraud enforcement unit within the Criminal Division.

This is some very good news indeed:

The Obama administration is dramatically beefing up the fraud section of the U.S. Department of Justice’s Criminal Division as it tries to add muscle to back up its rhetoric about cracking down on health care and corporate fraud.

The department is looking for what Assistant Attorney General Lanny Breuer calls "a superstar" to lead the fraud section. It also plans to add 10 trial attorneys and fill the long vacant job of deputy chief for corporate, securities and investment fraud.

That promise of extra bodies is critical: The fraud section is already the Criminal Division’s largest litigation unit. With additional resources and the strong backing of Justice higher-ups for more fraud prosecution, the new chief should become the bane of defense lawyers’ existence nationwide.

Oh, frabtacular day, if they follow through on this.

Serious criminal enforcement of fraud has been needed for a long, long time.  Say, at least, about eight long years.

Gee, wonder how the utter lack of real tooth-filled enforcement the last few years happened?

Can you say Barbara Comstock, Alice Fisher and their ideological soulmate pals? I know I sure as hell can…

“It’s Washington. Eyebrows were raised last month at just how cozy things were at the Justice Department’s Christmas party. Most notably, between Alice Fisher, the newly installed head of the Criminal Division, and her old buddy Barbara Comstock, a strategic public relations and lobbying consultant who represents two of the biggest Republican fish caught up in the corruption scandals engulfing Washington….

According to partygoers, the DOJ Christmas party was like a fish fry, with Comstock almost (though, come on, not really) like a PETA activist fighting to spare the lives of the Libbyfish and DeLayfish. One attendee described the party as “Lobbyist City” and said Comstock was “very conspicuous, buzzing around Alice.” The term “nauseating” was also used to describe Comstock’s palling around with the Criminal Division chief….

“I feel slighted,” Corallo said, laughing. “No one raised eyebrows about me.” He said “almost every lawyer” invited to the DOJ or the solicitor general’s parties “inevitably have business before the Justice Department.”"

This is good news indeed. The word superstar is a little disturbing but that’s just my own problem with the cult of personality that is so prevelant in todays culture. One doesn’t haven’t to be any good to be a superstar these days.

GM Christy and pups, a bit OT. Harry Reid will be in our town today for a fund raising lunch ($500/plate). I don’t know who will be there paying $500, but I know the Healther Skelter crowd will be on the street.

I don’t think there is a counter to the HS crowd (Health Scare, watch out), but I thought I would go over and try to talk to some of them about what health care/insurance they have. Maybe I’ll take a tape recorder. Will try to report back later on what I find out. I’m sure it will be interesting.

Why do people refer to professionals as “extra bodies” or even “warm bodies”? It’s offensive. These are people you want to accomplish something, not seat warmers or sinecures.

$500/plate for lunch is a lot for an event in NM, and I really don’t know who would be the audience for Reid here. Lockheed/Marietta? We don’t have much else, but who knows?

So I will talk to the rabble outside, if they will talk to me. I should look non-threatening. Will report what they have. I honestly am curious about the Healther crowd, why they oppose reform. They don’t all have Medicare/Medicaid, or do they? I know NM has about the highest rate of uninsured, lowest rate of employer coverage.

I got some good data from my visit to Sen. Bingaman’s office the other day.

The number of cases of fraud is in the millions. What we need to look out for is if corporations will be pursued criminally or not. We need to see too how many CEOs, CFOs, and board heads are taken down. While this is one piece of potentially good news, it won’t do much if broader reform and re-regulation are not enacted and enforced.
