SCOTUS And OLC: It’s All About The Right-Wing Moolah

All the smarmy Republican legal smear tactics?  Say it straight out: it’s all about the right-wing moolah.

Jane said it all here, but I’m risking a repeat:

Boy, does this sound familiar:

While conservatives say they know they have little chance of defeating Mr. Obama’s choice because Democrats control the Senate, they say they hope to mount a fight that could help refill depleted coffers and galvanize a movement demoralized by Republican electoral defeats.

“It’s an immense opportunity to build the conservative movement and identify the troops out there,” said Richard A. Viguerie, a conservative fund-raiser. “It’s a massive teaching moment for America. We’ve got the packages written. We’re waiting right now to put a name in.”

That’s exactly what NARAL did when Sandra Day O’Connor retired…

And when NARAL and others pulled their penny ante sideshow wimpery? We called them on it, day in and day out, for months on end. And took heaps of shit from Beltway insiders for being publicly honest about what everyone knew was privately going on: milk the base and cynically rebuild the coffers for the next election cycle PR, while doing nothing substantive about judicial nominees whose philosophies honestly threaten choice.

What are right wing bloggers and pundits doing about their version of frothing, fundraising hackery?

Playing along and hoping to reap some payback reward out of their lockstep shilling for the moneyed few.  Some of them enjoying it far too much, frankly.

The fact that these people keep getting airtime and column inches?  All the more infuriating because these specious arguments aren’t grounded in any legal reality that I ever experienced in all my years of courtroom work.  Especially galling when it pours out of mouths of people who know better because they have also been working lawyers.

Recently, ThinkProgress cataloged crapola hurled not just at Sotomayor, but also at OLC nominee Dawn Johnsen and others:

The right’s disingenuous claim that Sotomayor’s nomination must be obstructed are far from novel. Indeed, Sotomayor is only the most recent of Obama’s well-qualified nominees to receive the same shoddy treatment. Consider Dawn Johnsen…who may be the single most qualified attorney in the world to lead [OLC]. A former acting head of the OLC during the Clinton Administration, Johnsen was among the most outspoken opponents of Bush’s pro-torture policies. Nevertheless, Senate conservatives have successfully prevented her nomination from receiving a floor vote, often citing her pro-choice views for justification even though OLC’s role has little or nothing to do with abortion….

If Senate Republicans want to rediscover sanity, they could take a page from Dahlia Lithwick’s recent on-the-mark Slate column and ask a question that would tell us all far more about Sotomayor than any of the manufactured idiocy being peddled publicly:

…it strikes me as intuitively obvious that in order to succeed in a white man’s world, women must learn to see both sides in ways that men do not. If that is true, it just might make them "better" judges, at least in some circumstances….But if I could ask her just one question at her confirmation hearing about that Berkeley speech, that would be it.

But that would require them honestly caring about Sotomayor’s core and thought process, instead of making even bigger arses of themselves by catering to their crazed base.

Sadly, it’s all about the moolah.

Especially consistently rev up the frothing base on abortion and scary gay people

Whether they have any real merit or none whatsoever?  Doesn’t seem to matter.  Beyond shameful.

Conservatives with any conscience ought to stand up and say so. Now.

Because "bilk the base" is as cynical as it gets. And any sucker who falls for it gets exactly the vile level of leadership they deserve.

I just wish the rest of us didn’t have to suffer through the aftermath.

Morning Bev — am feeling much better, thanks to a whole drug regimen they have me on to ease off the infection that settled into all my joints. A bit of sleep and trying to take it easier than I might have otherwise has helped as well.

I think the GOP has known from the first week that Sotomayor’s confirmation was pretty much a given. It’s been all about the Senate Republicans skating that fine line between not pissing off the rabid base past the point of no return for upcoming political primary season and not looking loony to the general population that they need for the general election portion of the cycle.

Plus, aiding all the fringe fundraising somehow to stay on the good side of the extremist moneyed folks.

If RevBev is correct and Sotomayor gets overwhelmingly confirmed, all this kabuki is to raise $$$ and also to do some horse trading for the next nominees. If BO goes 2 terms, I believe that he will have 2-3 more seats to fill on SCOTUS.

Yes, unless something new unexpectedly turns up, it looks like the Sotomayor confirmation battle might turn out to be a mere squirmish.

Now, it looks like the real battle, the one where all the political armies will be marching up and down the Potomac and the money launderers on K Street will be working their vile mischief 24/7, is health care.

I do think an awful lot of this is nudging not just for SCOTUS nominees, but especially on federal courts nominations. Trying to push rightward, so that no more left-leaning judges make their way through the pipeline if the right wing can help it.

There is so much moolah tied up in lobbying on health care that it’s almost become a shadow agency when you start looking into who is doing what on KStreet and elsewhere. The revolving door from the Hill to KStreet and back again is absolutely crazy.

I also think these 2 topics–judges & health—may be a part of why Obama is/appears out of gear on the torture stuff. Not really sure…but I do believe that he has decided this is the health care moment and he does not want to lose it or complicate it more. If the public and the courts are the agents and voices in the torture arena, he may otherwise have more leverage. Yes….who knows?

Great Point the system GOP/Blue Dog its all about maintaining the status quo and keeping both the Left and the Rights bases angry so they give money and vote.
But with the Net our side at least is kind of trying to educate on the issues.
We need to do more of this last thread a few folks were getting rightly mad that we were getting down on Obama to much.
I think educating more about issues we know are coming up before the government debates them might help.

Think of it this way we elected Obama to stop the war, give us National Healthcare then then the economy failed and rather than trust the probusiness party with the economy we preferred to elect an African American.
The GOP has nothing else but Abortion an issue they have not delivered on for their base despite having control of the Presidency through the Reagan, Bush, Bush 2 years.
They got Racism after a majority of the country elects an African American President. And as the country gets more Hispanic they attack immigrants.
They got Gay Marriage as more and more states legalize it.
Yes the GOP can expect their shrinking base to give more because everything they feared is happening.
Who cares though when the world does not end tomorrow or the next day:)
The old will die and take their fear with them. The new hate the Tea Baggers do not look like they will be enough to replace the natural die off of the GOP base.
I bet McCain wishes he had voted for National Healthcare ten years ago enough of his older white male base might have been alive today to make him President.

Dawn Johnsen is supported, if not sponsored (sorry – not sure) by Dick Lugar (R- Irrelevant – IN).

If they wanna shoot Lugar in the foot, so be it – he’s been a shoe-in vote on every single R-backed thing for several years now. Guy used to be a respectable Senator too.

Keep on shooting, R’s. Ever heard of collateral damage?

Thanks for re-emphasizing this “money talks” point Christy!

And for once in my life, I have to compliment the Repugs.

No one, not anybody in history, has ever so successfully identified the bestest chumps to con out of their money.

If one were to guess the average IQ of their donors (as well as incidence of mental instability), the Repugs have cornered the market on crazies and fools.

And they ain’t gonna give ‘em up. No way, no how!

Taking candy from babies is hard work compared to this.
