Here are the results from your calls to Senators thus far in support of Dawn Johnsen for OLC:

Boxer:  Staffer didn’t know.

Byrd: Staffer didn’t know.

Cornyn:  No (although the local office thinks he may be listening to constituents).

Feinstein: Hasn’t made up her mind on first call.  Second call to her office staffer says she intends to vote for Johnsen.

Hutchinson: Hasn’t made her wishes known publicly.

Rockefeller: Staffer didn’t know.

Whitehouse:  I know for certain he’s supporting Dawn’s nomination, so good for him.

Please keep the calls going to your Senators in support for Dawn Johnsen. Remember, you can double your impact by phoning local offices as well.

Bingaman: Staffer is “[n]ot aware of Senator Bingaman’s position.”

Udall: Staffer says "“Senator Udall hasn’t taken a position,” but she sounded happy that I called in support.

Voinavich: No public statement on this as yet.

Thanks demi. Given all the revelations we’ve dug out of the OLC memos thus far, is it any mystery why this appointment is important to me? Or why it ought to be important to all of these elected folks under the circumstances that DOJ is operating at the moment?

Honestly, you’d think they would be running to fill that position to get the mess cleaned up entirely. At least, you’d hope they’d take their jobs seriously enough to do that.

just called Sen. Sherrod Brown’s office, guess what>?

no statement yet. girl said that he hadn’t looked at all of the nominees yet so wasn’t releasing anything yet..i said, who else is on the list that is as qualified as dawn johnsen? she put me on hold, then came back and siad that he is leaning that way, but no statement yet.

i said that is not what i expected to hear, and that NOW is the time for him to ’step-up’ and make a statement-considering what the republicans are doing to derail it and considering the memos released. You know about the released memos, don’t you? she said oh yes. i said, He needs speak up about it now. that is what he is there for, to do things like this. that this is not something he should be putting on the back burner.

they don’t want it cleared up. too much fuel for fodder. too much leverage in a myriad of ways. physically and psychologically.

Christy, possible update on Cornyn…I just spoke with one of his staffers and more or less nailed him to the wall about whether he is going to continue the foot dragging. The staffer stated that Cornyn thinks “it is important to get nominees through.” Cornyn apparently wants to have an open debate about Ms. Johnsen (due to something really nasty etc etc) on the Senate floor. The staffer seemed somewhat confused about the 60 vote cloture / filibuster issue, though. I related to him that the Republican foot-dragging is not playing well and that our country has too many problems for this to be going on. He said he would relate it to the Senator…

Don’t skip over the fact that, for now at least, it’s more convenient for Obama to not have her at OLC. If she had been there and had issued an opinion that there was a duty under CAT to prosecute torture it would have made Holder’s and Obama’s letter of exculpation much more problematic.

My guess is there will not be any Dem push to get her into the slot until Obama finishes some more whitewash (including shipment back to torture sponsors of GITMO detainees and related) and then, if he really want her he won’t have any problem getting her confirmed. But he’s got a lot of reason to not really want her confirmed yet – it makes life much easier for him.
